This Electronic Communications & E-Sign Consent (the "E-Sign Consent") describes how PayactivUSA and its lender partners communicate with you electronically, including your right to receive disclosures electronically and to use electronic signatures.
1. Scope of consent
By submitting the Payactiv application form on this site, you consent to receive the following types of communications electronically:
- Disclosures required by the Truth in Lending Act (TILA), Equal Credit Opportunity Act (ECOA), Electronic Fund Transfer Act (EFTA) and other applicable laws.
- Loan agreements and credit disclosures from any lender partner you proceed with.
- Privacy notices and opt-out mechanisms.
- Status updates about your Payactiv funding application.
- Service and transactional messages related to any product you accept.
2. Hardware and software requirements
To receive electronic communications you need:
- A device with internet access (desktop, laptop, tablet, smartphone).
- A current web browser that supports TLS 1.2 or higher (Chrome, Firefox, Safari, Edge).
- A working email address and the ability to receive and open PDF attachments.
- Enough storage space to save or print documents, or the ability to re-request them.
3. Withdrawing consent
You have the right to withdraw this E-Sign Consent at any time. To withdraw, email legal [at] payactivusa [dot] com with "Withdraw E-Sign Consent" in the subject line, including the email address and phone number used on your application. Withdrawal is prospective — it does not affect disclosures or signatures already delivered or executed.
4. Requesting paper copies
You may request paper copies of any electronic disclosure. Email legal [at] payactivusa [dot] com with "Paper Copy Request" in the subject line. There is no fee for paper copies of PayactivUSA's own notices; lender partners may charge for paper copies of loan documents, which they will disclose.
5. Keeping your contact information current
If your email, phone number or mailing address changes, update it promptly by emailing legal [at] payactivusa [dot] com or through the lender partner's account portal (for any accepted loan). We are not responsible for communications sent to outdated contact information you have not updated.
6. Legal effect of electronic signatures
Under the federal Electronic Signatures in Global and National Commerce Act (E-Sign Act, 15 U.S.C. §§ 7001 et seq.) and the Uniform Electronic Transactions Act (UETA) as adopted by your state, your electronic signature has the same legal effect as a handwritten one. By clicking "I agree," "Submit" or an equivalent affirmative action on PayactivUSA or a lender partner's site, you are legally bound as if you had signed on paper.
7. Record retention
We retain records of your consent and the electronic disclosures delivered to you for the period required by applicable law and lender-partner agreements.
