Your rights at a glance

Depending on where you live, you may have the right to:

  • Know what personal information we have collected about you.
  • Access a copy of the personal information we hold.
  • Correct inaccurate personal information.
  • Delete personal information we have collected.
  • Opt out of the sale or sharing of personal information. PayactivUSA does not sell personal information for monetary consideration.
  • Opt out of targeted advertising or profiling that produces legal or similarly significant effects.
  • Appeal a denial of any of the above requests.
  • Non-discrimination โ€” we will not retaliate against you for exercising your rights.

Categories of personal information we collect

  • Identifiers โ€” name, email, phone, mailing address.
  • Financial information โ€” amount of Payactiv funding requested, employment details.
  • Internet activity โ€” pages viewed, time on page, referral source.
  • Geolocation โ€” approximate (city/state) from IP, when relevant to state eligibility for lender partners.
  • Device information โ€” browser, OS, device type.

How we use personal information

  • To route $200โ€“$5,000 funding applications to licensed lender partners in your state.
  • To respond to contact-form questions.
  • To improve the site, our Payactiv articles and user experience.
  • For fraud detection and legal compliance.

How we share personal information

We share application-form data with licensed lender partners so they can evaluate your personal-funding request. We may share aggregated, non-identifying data with analytics vendors. We do not sell personal information to data brokers.

Retention

We retain personal information for the shorter of (a) the period needed to fulfill the purpose for which we collected it, or (b) the period required by applicable law. Application-form data is typically retained for 24 months unless a longer period is required.

How to exercise your rights

Submit a request by emailing privacy [at] payactivusa [dot] com with "Privacy Request" in the subject line. Please include:

  • Your full name
  • The email or phone number you used on the site
  • The state in which you reside
  • The specific right you are exercising (access, delete, correct, opt out, etc.)

We will verify your identity using the information you provide and the data we have on file. We aim to respond within 45 days (CCPA) or the equivalent window required by your state law.

Authorized agents

You may authorize an agent to submit a request on your behalf. The agent must provide written proof of authorization (signed Power of Attorney or equivalent), and we will separately verify your identity.

Appeals

If we deny your request in whole or in part, you may appeal by replying to the response email with "Appeal" in the subject line. We will review the appeal and respond within the window required by your state law.

Shine the Light (California)

California residents may request a list of personal information disclosed to third parties for the third parties' direct-marketing purposes. We do not share information in that manner, but you may still submit such a request to privacy [at] payactivusa [dot] com.

Do Not Track

PayactivUSA does not currently respond to Do Not Track browser signals in a technically unique way. We do honor Global Privacy Control (GPC) signals as an opt-out of sale/sharing where applicable.
